Full Terms of Service

This Rental Agreement ("Agreement") is entered into on between:

You, the Customer (as identified in your booking confirmation)


1. Equipment Rented

All equipment and rental details are specified in your booking confirmation email. This agreement applies to all equipment listed in that confirmation.

2. Delivery, Setup, and Access Requirements

2.1 General Delivery

Company will deliver, set up, and collect the equipment at the address you provide within the windows agreed upon in your booking confirmation.

2.2 Ground-Level Access Only

Our arcade cabinets and game units are heavy and cannot be safely disassembled for transport. All delivery and pickup locations must be accessible via ground-level entry — no stairs, steps, elevators, or multi-level access required. This includes upstairs units, second-floor patios, walk-up apartments, and venues requiring equipment to be carried up or down stairs.

⚠ Important: If your delivery location requires stair or elevator access, disclose this at booking. Accessing upstairs locations will not be possible, and the full rental and delivery fee will be forfeited with no refund.

2.3 Site Requirements

You are responsible for ensuring:

2.4 Surface Requirements by Equipment Type

Lawn Games — a level surface is required. Gravel, dirt, grass, or concrete are all acceptable. Extreme slopes are not. The surface must not be wet or muddy at the time of setup.

Arcade Cabinets — a level, hard surface is required. Equipment will only be placed on concrete or wood. Arcade cabinets will not be set up on gravel, dirt, grass, sloped surfaces, or any wet or muddy surface. Failure to provide an acceptable surface may result in cancellation of the rental with no refund.

3. Rental Period

3.1 Duration

The rental period begins at the time of delivery/setup and ends at the scheduled pickup time in your booking confirmation. Extensions must be requested in advance and are subject to availability and additional fees.

4. Payment and Booking Deposit

4.1 Booking Deposit

A $50 booking deposit is required to reserve your date. This deposit is refundable or non-refundable depending on cancellation timing (see Section 8). The remaining balance is due no later than 3 days before the event.

4.2 Damage & Security Deposit

The $50 booking deposit also serves as security for equipment damage, missing components, or excessive cleaning. If equipment is returned in good condition and all terms of this Agreement are met, the full $50 will be returned within 5 business days of pickup.

4.3 Payment Methods

We accept all major credit cards via Stripe. Sales tax applies per California law.

5. Damage, Loss, and Equipment Care

5.1 Your Responsibility

You are responsible for the equipment from delivery until Company staff confirms pickup and inspection.

5.2 Proper Equipment Care

You agree to use equipment only as intended and to take reasonable care to prevent damage:

You are financially responsible for any damage, malfunction, missing parts, or loss beyond normal wear and tear, including but not limited to:

5.4 Damage Charges

Repair or replacement costs will be charged at Company's actual cost to repair or replace the item, up to its full replacement value. Company will provide documentation (photos, repair invoices, or replacement quotes) supporting any charge.

5.5 Payment of Damage Costs

Any damage costs exceeding your $50 deposit will be invoiced separately and are due within 10 days of invoice.

5.6 Equipment Malfunction During Your Event

It rarely happens, but we take it seriously when it does. If a piece of equipment malfunctions during your rental through no fault of your own, contact us immediately and we'll troubleshoot remotely or dispatch someone to assess the situation. If we can't get it working, we'll prorate the amount paid for that item in 30-minute increments and refund the remainder. We maintain and test all equipment before every event specifically to avoid this situation.

6. Weather Policy (Outdoor/Lawn Games)

6.1 Pre-Setup Weather Cancellation

If inclement weather (rain, lightning, high winds) prevents Company from safely delivering or setting up the equipment, the rental will be cancelled and your deposit and payment will be applied to another rental date within 90 days of the original event, at your choosing, subject to equipment availability. No additional charges will apply to the rescheduled date.

6.2 Post-Setup Weather

If inclement weather occurs after the equipment has been fully set up and the rental period has begun, the full rental fee is due. You assume the risk of weather after setup is complete.

6.3 Your Responsibilities

You are responsible for providing a safe, dry, reasonably level setup area. You should monitor weather forecasts and make contingency plans (tents, canopies, relocation within the venue) to protect the equipment during your event.

7. Assumption of Risk & Liability

7.1 Your Assumption of Risk

You assume all risk of injury or harm arising from the use of rented equipment by you, your guests, or any other individuals at your event.

7.2 Company's Limitation of Liability

Company is not liable for injury, property damage, or loss arising from misuse of equipment, failure to supervise minors, or use inconsistent with the equipment's intended purpose.

7.3 Indemnification

You agree to indemnify and hold harmless Popup Arcade SD LLC, its owners, and employees from any claims, damages, or costs (including legal fees) arising from your use of the equipment, except where caused by Company's gross negligence.

7.4 Insurance

Company maintains general liability insurance and can provide a certificate of insurance upon request for venues that require one.

8. Cancellation Policy

8.1 More Than 7 Days Before Event

Your $50 booking deposit is fully refunded. You may pay the remaining rental fee balance only if rescheduling to another available date.

8.2 Within 7 Days of Event

Your $50 booking deposit is non-refundable. The rental fee balance is also non-refundable.

8.3 No-Shows & Inaccessible Locations

No-shows or inaccessible delivery locations (see Section 2) result in forfeiture of both your $50 deposit and the full rental fee.

9. General Terms

9.1 Entire Agreement

This Agreement constitutes the entire agreement between the parties regarding the rental described above.

9.2 Governing Law

This Agreement is governed by the laws of the State of California, with venue in San Diego County.

9.3 Severability

If any provision of this Agreement is found unenforceable, the remaining provisions remain in full effect.

9.4 Acknowledgment

By selecting "I Agree" during checkout, you acknowledge having read, understood, and agreed to all terms of this Agreement, including the delivery access requirements in Section 2 and the damage liability terms in Section 5.
